ACCOMMODATION TERMS & CONDITIONS OF HIRE

UPON HIRING ACCOMMODATION VIA THE KINGSCOTE BARN, THE HIRER IS CONFIRMING TO HAVE READ, UNDERSTOOD AND AGREED THE FOLLOWING TERMS AND CONDITIONS AND WILL BE BOUND BY THESE.

Barn: The Kingscote Barn Ltd. Binley Farm, Kingscote, Tetbury, Gloucestershire GL8 8YE (also described as “we” or “us”).

Accommodation: The room or property booked by you the client in accordance with these terms and as agreed with the Barn.

Hire Period: As per your booking confirmation letter including terms in clause 2.6

Number of Guests: The maximum occupancy as stated in Clause 2.4 must not be exceeded (+1 travel cot per room) *travel cot not provided.

  1. Booking Information

1.1 You confirm that the details set out in the attached covering letter are accurate and that you will notify us as soon as possible of any changes. Your hire of the Accommodation is subject to these Terms and Conditions of Hire together with the attached covering letter

1.2 The booking will be confirmed on receipt of your Full payment for the accommodation. If payment is not received, we shall be entitled to cancel the booking on giving you written notice to that effect and, in these circumstances, clause 3 will apply as though you had cancelled the booking. We accept Mastercard, Visa and Delta. We do not accept American Express.

  1. Hire

2.2 Guest details: we require details of all persons who will be occupying the accommodation during the hire period, including names and number of children/infants staying. Booking will not be confirmed until these details have been received. If additional guests are joining/leaving between the booking dates, we also require their names and details as above. Only persons named within the booking are authorised to stay at the property.

2.3 The Barn reserves the right to amend any published pricing at any time with reasonable prior notice. All prices are inclusive of VAT but may be subject to change of rate and any other relevant taxes prevailing in force of the date of the hire. All payments are non-refundable and non-transferable.

2.5 Family Rooms

Family rooms are available upon request and portable beds/cot can be added if needed. Additional charges apply for this, please ask upon booking. We will determine whether a room is suitable for the purpose of this offer. All children (a person under 16 years of age) staying with us must be accompanied by an adult and must be supervised by an adult at all times.

2.6 Arrival and Departure

Arrival and departure times are detailed on your booking confirmation.

Late Departure- is not usually possible but occasionally we may be able to arrange it with an extra charge. We reserve the right to make a charge to cover any costs arising from unplanned late departure.

2.7 We reserve the right for our staff or contractors to access accommodation if an unforeseen problem arises. Your occupation is not exclusive.

  1. Meal Arrangements

Rooms are usually priced on a room only basis. Rates which include breakfast offer a continental breakfast hamper including tea or coffee, unless stated otherwise. There is no refund for meals which are not taken by guests, but we may be able to swap it for an equivalent value extra item if requested.

  1. Cancellation by Client 

Cancellation of the booking will result in the loss of the any payments made, no refunds will be given unless the accommodation is able to be re-let at full price. We recommend taking out insurance to cover unforeseen circumstances including adverse weather or any other conditions that may lead to cancellation of the booking.

  1. Cancellation by Barn 

We shall be entitled to cancel a booking by giving written notice if an event beyond our reasonable control occurs, in which circumstances any monies paid to us by you at the date of cancellation shall be returned in full within 14 days. We cannot accept liability for any additional costs incurred as a result of the cancellation.

6.Prohibited Activities 

All accommodation is subject to a strict NO Smoking policy including E-Cigarettes.   Smoking is only permitted outside the property.

Candles are prohibited in ALL Accommodation.

Fireworks, Sparklers, Open Fires and BBQs are prohibited.

Chinese Lanterns are not permitted as it puts our animals at risk.

A minimum fee of £125 will be charged to cover deep cleaning if we find misuse of any of the above activities

  1. Damage 

Whilst ordinary and fair wear and tear is expected and allowance made for such, the hirer is liable for any loss, damage caused or repairs necessary to the Accommodation including all fixtures & fittings, furnishings and equipment and for any loss of rental income suffered by the Barn as a result of any such damage.

You agree to notify us of accidental damage, spillages or lost keys prior to departure. We reserve the right to make an appropriate charge to cover the cost of any extra cleaning necessary to return accommodation to normal use.

7.1 Each accommodation is inspected after guests’ departure. You will be notified within 36hrs of departure the cost of any loss or damage incurred during your stay (or longer if for reasons beyond our reasonable control it takes the barn longer to assess the value of loss and or damage incurred.)

The barn reserves the right to charge for this from your secure card details provided at booking.

7.2 We strongly recommend that guests take out adequate insurance, in addition to protect against cancellation costs and unforeseen circumstances in the event of liability incurred against any loss/damage charges.

  1. Children

Children are welcome at the Accommodation but must be accompanied by an adult who will supervise appropriately and ensure that any children under the age of 12 remain within the boundaries of the Accommodation unless accompanied.

  1. Pets Service Dogs are welcome as are well behaved dogs and other pets ONLY by prior arrangement with the Barn. A dog friendly room cannot be guaranteed. Dogs must be kept under strict control at all times. A minimum charge of £50.00 will be made if pets are brought onto the premises without prior arrangement
  2. Personal belongings left behind

If guests or any members of your party leave any personal belongings at the accommodation you will be charged the cost of postage and packaging and an admin fee to have them returned to you. Any items found will be disposed of within 7 days if not claimed. All food and drink will automatically be disposed of following departure.

  1. Noise disturbances

The barn accepts no liability for any noise disturbances including anything arising from neighbouring accommodation.

  1. Liability of the Barn 

12.1 We shall not be responsible for:

(a) any loss or claim due to mechanical breakdown or failure in electricity supply beyond our reasonable control;

(b) any loss or damage to any property (including motor vehicles and their contents) brought onto the premises by any person;

(c) any injury to or any other loss or claim by any person at the Accommodation, provided that we do not exclude liability for death or personal injury arising out of any negligent act or omission by us.

12.2 In the unlikely event that we are unable to provide the Accommodation in accordance with these Terms, our total liability to you in connection with such failure will not exceed the Accommodation charges. This does not affect your statutory rights.

  1. Miscellaneous 

13.1 Nothing in these Terms is intended to confer any benefit on any third party or the right to enforce any of these Terms.

13.2 These Terms, together with the covering letter represent the entire agreement between us and supersedes any previous agreement whether oral or written. These Terms and Conditions are subject to change from time to time in accordance with the Barn’s business requirements, and the Barn shall notify any such changes to the client as soon as possible.

13.3 Please ensure that all guests within the booking are fully aware of The Terms & Conditions.

13.4 These Terms and Conditions shall be governed by the laws of England and Wales.
